r1 1983 <br />SEP 2 ar�K rAc� 688 <br />DESCRIPTION & CONDITIONS: <br />Golf Palm View Estates is a 10 lot subdivision, located on the <br />north side of 30th Street, west of 11th Avenue. The subject <br />property is zoned R-lA, Single -Family Residential, (4.3 dwelling <br />units/acre) and has a LD -1, Low -Density Residential, (3 dwelling <br />units/acre) land use designation. The proposed building density <br />is 2.78 dwelling units/acre. <br />ALTERNATIVES & ANALYSIS: <br />The applicant has complied with all County requirements <br />concerning subdivisions, with one exception. Section 22-54 <br />(A)(8) of the County's Subdivision Ordinance 75-3 states that, <br />"Whenever a tract to be subdivided borders on an existing half t <br />or partial street, the other part of the street shall be. <br />dedicated within such tract." Thirtieth Street is an existing <br />half street. The existing right-of-way is 351 V size, so under <br />the conditions of this provision, the applicant shall be <br />responsible for providing an additional 15' of right-of-way. <br />The applicants have requested a variance from this provision in <br />the ordinance (see Attachment 4). The reason for this variance <br />request, as stated in the letter from the applicant, is that, in <br />order to provide additional right-of-way, the applicant would <br />have to utilize Indian River Farms Drainage District land. The <br />district's main relief canal right-of-way abuts the northern <br />border of the existing 30th Street pavement. This land would <br />have to be acquired from the Water Control District. 'The <br />District has been contacted, and has informed staff that they <br />would not be willing to have any of their right-of-way used for <br />the purpose -of providing street right-of-way for residential <br />development. In fact, according to the District, as Indian <br />River County grows, that right-of-way will have to be used for <br />expansion of the Main Canal. The County Engineer has reviewed <br />this variance request and has also recommended that it be <br />approved. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant, <br />to the applicants, a variance from Section 22-54 (A)(8) of the <br />County's Subdivision Ordinance, requiring extension of the <br />existing right-of-way to a width of 501. Staff further <br />recommends that the Board of County Commissioners grant <br />preliminary plat approval to Golf Palm View Estates Subdivision. <br />MOTION WAS MADE by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, that the <br />Board approve preliminary site plan for <br />Golf Palm View Estates Subdivision with a <br />variance, as recommended by staff. <br />In discussion, Commissioner Lyons was assured by <br />Attorney Brandenburg that the County has the right to grant <br />the variance. <br />s0 <br />
