Poupard OAP Amend to Sec. 25 <br />Planner I CLARE <br />It is requested that the information presented herein be given <br />formal consideration by the Board of County Commissioners at <br />their special meeting on October 12, 1983. <br />-DESCRIPTION & CONDITIONS <br />This draft amendment of the existing Fence Ordinance makes two <br />major changes in the existing ordinance. First, the draft <br />amendment allows certain types of fences, those higher than <br />specifically permitted by the ordinance and those constructed of <br />barbed wire, to be administratively approved. This will relieve <br />the Planning and Zoning Commission from having to review these <br />applications, and will also speed up the fence permitting <br />process. This Fence Ordinance amendment does allow applicants <br />to appeal any administratively made decisions to the Planning <br />and Zoning Commission. The second significant change in this <br />draft amendment is that fence construction will be permitted in <br />easements. Applications for fence construction in easements <br />will have to be reviewed and approved by all applicable County <br />Divisions, as well as by any agencies which might be affected by <br />this construction (see Attachment 1). Also, applicants for a <br />fence permit of this type will be required to sign an agreement <br />committing the owner to bear any expenses involved in fence <br />removal and/or reconstruction, if it becomes necessary for work <br />to be done in the easement (see Attachment 3). <br />A third, less significant change, was also made in the draft <br />ordinance. The permitted front and sideyard heights were <br />changed. This was done to make the side and rear yard allowed <br />heights uniform and to give applicants greater flexibility when <br />constructing fences. <br />The Planning and Zoning Commission considered this draft <br />ordinance at their regular meeting on August 25, 1983. At that <br />time, the Planning and Zoning Commission unanimously recommended <br />to the Board of -County Commissioners that it adopt this <br />amendment to the ordinance. <br />ALTERNATIVES & ANALYSIS <br />Staff requests that the Board of County Commissioners review <br />this amendment to the Fence Ordinance and consider whether it <br />addresses all necessary criteria. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners adopt <br />this amendment to Section 25(i) of the Zoning Code, known as the <br />Fence Ordinance. <br />11 <br />OCT 12 1983 <br />I <br />
