Chairman Bird asked Mr. David Kabbord, developer of <br />Seagrove, if he would be willing to post signs saying there <br />is a hazardous tree condition and Mr. Kabbord agreed to <br />this. <br />Director Davis explained that if the developer is <br />allowed to post a performance bond, it will cover items 3, <br />4, & 5 under Alternative No. 1 of the above memo, and that <br />the Board must make a decision on granting a variance` on <br />items 1 and 2. <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, that the <br />Board grant the release of the Letter of Credit <br />on Seagrove South Subdivision; subject to the <br />following conditions: <br />1) that a variance be granted on the trees that <br />are closer than 5 feet to the road with the <br />understanding that satisfactory warning and <br />speed limit signs be posted; <br />2) that the Board recommends that the subdivision <br />enter into an agreement with the property <br />owner where the street goes into a private <br />owner's property. <br />3) that we accept a cash bond of $2,000 to <br />cover the items that are yet to be completed. <br />Under discussion, it was pointed out that final plat <br />approval has been granted and that this is simply a request <br />to release the Letter of Credit that was posted for the <br />improvements. <br />Commissioner Bowman restated her concern about the <br />County assuming liability if anyone hits one of these trees. <br />Attorney Brandenburg felt that the County Commission by <br />establishing guidelines for allowing private subdivisions to <br />29 <br />OCT 19 1983 $ K 55 PKE JLU, <br />
