OCT 19 1983 <br />` MU <br />placed in the County's escrow account until the items are <br />completed. - <br />In regard to the matter of roadway, Director Davis <br />explained that some pavement has encroached upon the <br />right-of-way, and the County Attorney and the Public Works <br />Dept. feel that the roadway should be within the <br />right-of-way. This is a private road system -- it is not to <br />be designated to the County. However, for proper <br />maintenance of the roadway, it has been recommended that an <br />easement or some other right-of-way expansion be provided so <br />that the roadway will lie within the designated <br />right-of-way. The developer has indicated that the road was <br />widened at one point with the consent of the property owner. <br />Attorney Brandenburg explained that in the case where <br />the .road was widened, it was an agreement between the <br />developer and the property owner. The only concern the <br />Public Works Dept. has is that of proper maintenance where <br />the driveway in question meets the street. He recommended <br />that the developer enter an agreement to that effect to <br />settle that matter. <br />Considerable discussion took place regarding trees in <br />the subdivision being too close to the roadway. There are <br />49 trees, mostly palms, involved and many of these could be <br />relocated with a tree spade. The Commissioners agreed that <br />every effort should be made to preserve the trees along the <br />streets but were concerned that the County aright be <br />responsible for a hazardous condition if they approve a <br />variance. Attorney Brandenburg assured them that these were <br />private streets and not the legal responsibility of the <br />County, but suggested that they post some speed limit and. <br />warning signs re tree hazards at the entrance to the <br />subdivision. <br />M <br />
