1) The Railway must have an inspector on site during the <br />work with cost paid by the County. <br />2) The County must pay a $50.00 license fee. <br />3) The work must be performed in accordance with FEC Specs. <br />4) The pipe is within the FEC right-of-way under sufferance. <br />5) The County must agree to indemnify and hold harmless <br />the FEC in any damages caused by the work. <br />RECOMMENDATIONS AND FUNDING <br />It is recommended that the Chairman be authorized to sign <br />the Agreement. Funding to be from the 16th Street project account <br />and yearly license fee from -the Road and Bridge Department Permit <br />account. ° <br />Assistant County Attorney Chris Paull explained that <br />each license agreement requires that the County pass along <br />certain indemnification requirements to the project <br />contractor. Due to a delay in getting the contractor to <br />look over these requirements, the County does not have a <br />secure indication of whether the project will require a <br />change order to the present 16th Street Improvements <br />Contract, thereby requiring additional insurance. He <br />recommended that Items A & B be postponed until that <br />information is available from Dickerson, Inc. <br />ON MOTION by Commissioner Lyons, <br />SECONDED by Commissioner Scurlock, the <br />Board unanimously postponed the above <br />matter until full information is available. <br />B.
