FMRiD'� <br />32981-2.58" <br />Ennessy Buick -Cadillac, Inc./Luria's Shopping Center <br />Dear Mr. Brandenburg: <br />This letter is to review circumstances and developments <br />concerning the interest of my client, Ennessy Buick -Cadillac, <br />Inc., and the owner of the property immediately south of the <br />Luria's Shopping Center. My clients have an interest in the <br />development of the Luria's Shopping Center and all property <br />adjacent to it. <br />Quite some time ago, my clients took every measure thought <br />reasonable to place the county, all of its employees, its staff <br />and the Planning and Zoning Commission on notice that they wan- <br />ted to be heard on all matters concerning site plan application <br />and approval for the Luria's Shopping Center, the adjoining <br />mobile home section immediately to the north thereof, and the <br />Russell Concrete Road between my clients' property and the <br />Luria's property. <br />In May, my client, Ennessy Buick -Cadillac, Inc, through <br />its President, Mr. Pierce R. Ennessy, personally reviewed and <br />made known its position concerning the Luria's property, with <br />Mr. Bruce King. Basically, my clients wanted to know of any <br />and all developments concerning the construction, approval, <br />site plan approval and development of the above -referenced <br />properties. My clients wanted to be heard and wanted their posi- <br />tions to be known and made a part of any decision concerning <br />development of those properties. Mr. King was aware of these <br />requests and positions,and informed them that they would re- <br />ceive actual and written notice of all matters and hearings <br />to be held and brought before the Planning and Zoning Com- <br />mission -on any site plan application, change or modification. <br />Unbeknownst to my clients,the site plan application was <br />apparently heard and approved on September 8, 1983. Although <br />Mr. Ennessy called the Planning and Zoning Commission staff <br />various times, and requested to be kept informed, and requested <br />notice of all such hearings, he was never notified of the <br />meeting and was therefore not allowed to present his concerns <br />and position nor allowed to protect his company's interest in <br />any manner. My clients have a considerable amount of money in- <br />vested in their property, buildings and overall appearance thereof <br />It is apparent that although they did everything within, reason to <br />place the County on notice and thereafter relied on your em- <br />ployees statements and representations that notice would be <br />given, there never was any apparent input from or contact with, my <br />clients.
