THE CHAIRMAN CALLED FOR THE QUESTION. <br />The Motion failed by a 1-4 vote, with <br />Commissioner Wodtke voting in favor. <br />Commissioner Bowman felt that we had talked about <br />offering either the Administrator or the Attorney a 3 -year <br />contract so that we would not lose both of them at the same <br />time, -and Commissioner Lyons advised that they could <br />terminate their contract at any time during the contract. <br />Administrator Wright explained they could cancel <br />"only" after giving 60 days notice prior to the end of the <br />contract. He would prefer that it be 60 days for either <br />party, but he has made a commitment to this County and <br />intends to follow through with it. <br />Commissioner Wodtke wanted to know the relationship <br />between Items 5 & 6. Attorney Brandenburg clarified that it <br />is their opinion that should the contract be terminated at <br />the end of the initial term, the Administrator and the <br />Attorney should be entitled to some severance pay. <br />Commissioner Wodtke understood that Item 5 states that <br />the County can terminate the contract for "cause" and <br />severance pay would come into effect, and Item 6 states that <br />either party can terminate 60 days at the end of the <br />contract. He was concerned that if sometime in the future <br />the County has an Attorney or an Administrator who is guilty <br />of a crime or a felony, that this wording would force the <br />County to pay severance. But, if the County decides that we <br />want to terminate them, and give them 60 day notice, there <br />is no severance pay. <br />Administrator Wright advised that severance pay is <br />addressed either in Ordinance 82-10 or his employment <br />contract. It says something to the effect that if the <br />Administrator or Attorney is fired for committing a felony, <br />etc., they do not receive any severance pay. <br />N®W 16 1983 37 <br />Took 5 PAE 32 <br />
