DEC 211983 <br />ADDITIONAL COURT FILING FEES <br />s PACE' <br />The Board reviewed the following memo dated 12/14/83: <br />TO: The Honorable Members of the DATE: December 14, 1983 FILE: <br />Board of County Commissioners <br />SUBJECT: ADDITIONAL COURT FILING FEES <br />Circuit Court FS 28.241(1) <br />County Court FS 34.041(1) <br />FROM: Jeffrey Barton" REFERENCES: <br />Office of Management & Budget <br />The Board of County Commissioners has the ability to pass,by <br />ordinance,additional court filing fees to be used for specific pur- <br />poses, such as court facilities, law library, or legal aid program. <br />An analyzation of the three (3) prior fiscal years revealed <br />the following numbers of cases could have collected the additional <br />fee if an ordinance had been passed. <br />1982-83 <br />Circuit Court 1,992 <br />County Court 1,125 <br />Total 3,117 <br />1981-82 1980-81 <br />2,136 <br />1,397 <br />3,533 <br />1,924 <br />1,446 <br />3,370 <br />The Fla. Statute doesn't address a specific fee to be charged <br />(local policy should dictate a reasonable fee). Each $1 of fee <br />charged per case would generate $3,100 to $3,500 per year based on <br />past history. These fundswouldthen be placed into a specific <br />escrow account as outlined in the ordinance for the specific court <br />purpose. <br />We recommend the Board of County Commissioners authorize the <br />County Attorney to draw an ordinance using a step fee system similar <br />to the Brevard County ordinance. <br />1C.. <br />J—udgd Chtiild�s E. Staff did not come up with a r� <br />specific dollar recommendation, but determined that a $1.00 <br />filing fee would generate $3100-$3500 which could be used <br />for court facilities.
