copy of a 1976 ordinance from Brevard County that uses a <br />sliding scale for court facilities fees. Because of the <br />size of the damages that people are seeking, Circuit Judge <br />} <br />Charles E. Smith felt that the fee schedule in Circuit Court <br />should should be on a sliding scale. Judge Smith <br />recommended that the County Attorney be authorized to come <br />up with a system using the step fee and he hoped that the <br />local -county bar association would become involved. Judge <br />Smith preferred a minimum fee of $20.00 in the Circuit Court <br />cases and a $10 or $15 in the County Court cases. <br />DEC 211983 <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Bowman, that the <br />Board instruct the County Attorney to proceed <br />with a draft of an ordinance as outlined above <br />by OMB Director Barton. <br />Under discussion, Administrator Wright suggested that a <br />provision be included in the ordinance stating that no <br />expenditures can be made from this fund without specific <br />approval of this Board. <br />Commissioner Lyons reminded the Board that we are <br />running out of space in the law library and are going to <br />install sliding shelves in the very near future. <br />Commissioner Wodtke requested Director Barton to work <br />out more exact figures as to what these fees will generate <br />based on last year's cases and present the figures when the <br />ordinance comes before the Board for approval. <br />Director Barton explained all fees are waived for <br />indigents, except in Small Claims Court. <br />Attorney Paull stated it would be helpful to have some <br />idea of an upper cap to enable the Legal Dept. to determine <br />how many dollars to include in the ordinance.
