DEC 211983 <br />Future Land Use Pattern <br />BOOK 713, <br />The Comprehensive Plan designates the subject property and all <br />of the land immediately adjacent to it as LD -2, Low -Density <br />Residential 2 (up to six dwelling units per acre). East of the <br />subject property, along Old Dixie Highway, is the U.S. Highway <br />#1 MXD, Mixed -Use District, corridor (up to six dwelling units <br />per acre). The R-1 zoning of the subject property and the <br />surrounding property is in conformance with the LD -2 land use <br />designation and seems to be the most appropriate zoning for <br />this area. <br />Roads/Traffic <br />The subject property has access to 1st, 2nd, and 3rd Streets SW <br />(all classified as local streets on the Thoroughfare Plan). <br />However, the'.applicanthas arranged to haul the mined sand <br />north from the site over a haul road that would cross some <br />property -owned by the Tabernacle Baptist Church and connect <br />with 1st Place. The church has given written consent to this, <br />so the sand would not have to be hauled through the residential <br />subdivision. <br />Environment <br />The subject property is not designated as environmentally <br />sensitive.- However, this site is on the sand ridge, an impor- <br />tant aquifer recharge area for the County. If mining is <br />allowed on this site, safeguards will be necessary to ensure <br />that the creation of the lake will not harm the aquifer. <br />TT4-i 1 i ti cc <br />The subject property is not currently served by County water <br />nor wastewater facilities. However, this area of the County <br />does have County water, and arrangements could be made to tap <br />onto these facilities. This area also has County wastewater <br />facilities, but there -is not-- sufficient capacity for new <br />customers at the present time. <br />RECOMMENDATION <br />Based on the above analysis, particularly the surrounding land <br />uses and the Planning and Zoning Commission's recommendation, <br />staff recommends that the Board of County Commissioners deny <br />the applicant's request. <br />Edwin Schmucker of Total -Development came before the <br />Board acting as agent for the applicant, Mr. Wi-llhoite. He <br />believed there is a lot of misunderstanding all the way <br />around, not only with the people in the area but also with <br />the County Plannng.Department, which seems.to be concerned <br />that when this is rezoned, it will never be changed back <br />into residential. Mr. Schmucker stressed that the developer <br />actually has no desire to change the present residential <br />zoning, but since the definition of mining under the Code is <br />interpreted to mean that any removal of fill material off <br />
