Keat ng, ICP ACRES FROM R-1, SINGLE - <br />Planning & Development FAMILY DISTRICT, TO R -2B <br />Director MULTIPLE -FAMILY DISTRICT <br />FROM: i1ZS REFERENCES: <br />Richard Shearer, AICP Sanders Rezoning <br />Principal Planner DIS•RICH <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of January 4, 1984. <br />DESCRIPTION & CONDITIONS - <br />The applicants, represented by Christine Sanders as agent, <br />and the County are requesting to rezone approximately 3.53 acres <br />located one block north of North Gifford Road (45th Street) and <br />on both sides of 38th Avenue from R-1, Single -Family District, <br />to R -2B, Multiple -Family District, the subject property being <br />all of blocks 2 and 4 of Lord Calviert Estates Subdivision. <br />Ms. Sanders owns two lots in this subdivision and has submitted <br />notarized written statements from all of the property owners in <br />Blocks 2 and 4 of this subdivision, requesting a rezoning to a <br />multiple -family zoning district. Ms. Sanders proposes to build <br />a duplex on her two lots, a use which is not permitted under <br />the existing R-1 zoning. <br />On November 10, 1983, the Planning and Zoning Commission voted <br />4 -to -0 to deny this rezoning request for several reasons. The <br />Commission noted that this area was platted for single-family <br />lots, and they -felt that it should remain so. The Commission <br />also agreed with surrounding property owners who wanted to <br />maintain the single-family character of this neighborhood. <br />This denial was formally appealed by Ms. Sanders. <br />ALTERNATIVES & ANALYSIS <br />In this section, an analysis of the existing land use! pattern <br />will be presented as well as a discussion of the future land use <br />as established in the Land Use Element of the Comprehensive <br />Plan. <br />Existing Land Use Pattern <br />The subject property currently contains three single-family <br />houses on the east side of 38th Avenue and three duplexes on the <br />west side of 38th Avenue (the duplexes are non -conforming uses <br />in the R-1 district). The majority of the lots in the subject <br />property are vacant. North of the subject property is a single- <br />family house and two four-plexes (four-plexes are also non- <br />conforming uses in the R-1 district). East of the subject <br />property is a church and a large area that is being used for <br />outdoor storage, both of which are located in an R-2, Multiple - <br />50 <br />
