R _19R <br />BEAK 6L� <br />Mr. Olstein confirmed that the letter in question <br />(Intervener's Exhibit #7) was his cover letter to the rate <br />study done for Hutchinson Utilities. <br />Intervener Cockley cross examined Mr. Olstein in detail <br />trying to establish that Mr. Olstein relied on figures <br />supplied by management and the firm of Testone, Marshall & <br />Discenza, which firm had stated that they could not express <br />an opinion as to the veracity of these figures. Intervener <br />Cockley noted that, in other words, Mr. Olstein did not make <br />an independent rate study. <br />Mr. Olstein felt you have to define what an independent <br />rate study is. He noted that he has performed many rate <br />studies and he never has come up with all these numbers by <br />himself. He pointed out that he has identified where he got <br />these numbers, and each number is discussed with the person <br />providing it. <br />The Board of County Commissioners thereupon recessed at <br />12:00 Noon for lunch and reconvened at 1:30 o'clock P.M. <br />with the same members present, Commissioner Bowman being <br />absent. <br />Chairman Scurlock understood the position of the <br />Intervener and the Petitioner in regard to wanting all the <br />testimony written into the record, but requested that they <br />move ahead as quickly as possible. <br />Commissioner Lyons stated that he would like at the <br />earliest possible moment to make a motion to cancel the <br />public hearing. He felt he has heard enough testimony <br />presented to indicate that we do not have sufficient <br />information to set a rate. He stated that he also planned <br />to move that the only promise we can make to Hutchinson <br />Utilities is that as long as we are operating under a <br />49 <br />
