� � r <br />Mr. Duynslager stated that -he did not look at that, but <br />noted that you would expect to build pipelines for about <br />$20-25 a foot. <br />Intervener White noted that there has been some <br />testimony stating that the existing 60,000 gpd plant will <br />collapse shortly. He asked Mr. Duynslager for his opinion <br />on this after inspecting the structure. <br />Mr. Duynslager replied that the tank has deteriorated <br />some, but it does not appear to be on the verge of collapse. <br />He believed the existing plant is sufficient until a <br />regional plant could be built. <br />Attorney Micale wished to point out that his clients do <br />not have the right to expand outside their franchise area. <br />Commissioner Lyons noted that we keep talking about the <br />alternatives of moving and not moving; there is an existing <br />agreement between Hutchinson Utilities and The Moorings in <br />this regard, and he wondered if this is really a matter for <br />the Commission to become involved in. <br />Attorney Brandenburg stated that this Board has no <br />authority to require The Moorings to renegotiate that <br />contract; so, we have to accept that as a "given" at this <br />point. He believed they now are talking about the efficient <br />economic management of the system which would result in <br />lower rates, and that is the issue the Board should key in <br />on. <br />Intervener White informed the Board that he is building <br />a record in this case because he is going to request that <br />this franchise be rescinded based on the evidence from the <br />prior hearing in July of 1981 and the lack of information <br />supplied at that hearing. Intervener White continued that <br />the Agreement between The Moorings and Hutchinson Utilities, <br />which is in evidence here, provides that if the franchise <br />were not granted to Hutchinson Utilities, The Moorings would <br />use Hutchinson Utilities to operate the facility, and he <br />52 <br />'JAN 18 1984 BOOK .5' 5 <br />
