Scurlock, Jr., Chairman <br />Board of County Commissioners <br />1840 25th Street <br />Vero Beach, Florida 32960 <br />Dear Commissioner Scurlock: <br />For some time, we have been considering the proposal <br />previously outlined in your communication to our client, <br />Vista Royale Association, Inc. I am taking this oppor- <br />tunity to outline what I believe will be an acceptable <br />settlement of our differences based upon prior discussions. <br />1. The County would convey the parcel of property <br />on which the water plant at Vista is presently located <br />to Vista Royale Association, Inc. We would need the fol- <br />lowing: <br />A. Proof of access to the property from both <br />U.S.;rl and from the interior of the development. It would <br />be my surmise the County administration has this infor- <br />mation available, which would have been obtained at the <br />time of the transfer from the developer to the County. <br />B. We would need proof of title to the land <br />being conveyed. The County probably has title informa- <br />tion through the date of acquisition from Vista and this <br />can simply be updated in the form of a title insurance <br />policy. <br />C. We would request the County stake the prop- <br />ert_y or furnish a recent survey showing the location of <br />the boundaries of the property being conveyed. <br />2. There would be a conveyance of equipment and <br />material.utilized in the operation of the water plant. <br />The County would do the following: <br />A. The County would remove various well pumps <br />and equipment, which shall be in working order when re- <br />moved. It is our understanding these pumps need to be <br />removed or they will continue to deteriorate. The County <br />will take proper steps to store these pumps in.order to <br />prevent further deterioration of the equipment. <br />B. The material and equipment removed from <br />the plant site would be accounted for by the County and <br />returned to the site or a valuation agreed upon, which <br />would be reimbursed to the association, <br />Ain <br />
