FEB 2 2 1994 <br />180K 56 M, GE 216 <br />Chairman Scurlock expressed concern about the County <br />.owned Round Island Park acreage and believed we need to <br />enter into a relationship where the County retains control <br />of that as a public facility. He was also concerned about <br />wastewater facilities and wished to be sure our wastewater <br />allocation is left intact. The Chairman wished it made very <br />clear that the Commission is not taking a position on this <br />issue today and that it will be left up to the voters. <br />Commissioner Bird noted that we just purchased the <br />Stanny parcel next to Round Island to include with the park, <br />and he felt we need an understanding that we will continue <br />to be allowed to develop those parks under our regulations. <br />Commissioner Lyons concurred that the County at.least <br />wants to have a voice to ensure that this acreage is <br />maintained as public parks with rules agreeable to the <br />county. <br />Attorney Vitunac believed that everyone understands the <br />County really can't take a side and that signing the consent <br />card would just allow the people to have their say. As to <br />wastewater allocation, he did not believe the annexation by <br />itself would have any effect on any other agreements between <br />the City and County, and noted that the County Attorney has <br />determined the wastewater contract stands on its own as a <br />separate contract. He agreed that he will add the addi- <br />tional acreage the County has purchased. In regard to park <br />development if this acreage were annexed by the City, <br />although the County planners certainly could work with the <br />City planners on any problem, Attorney Vitunac did not <br />believe, as a matter of law, the City could say that City's <br />laws would not apply in this particular area. The County <br />would not be powerless, however, in the event the City were <br />to be uncooperative, as the County would have the remedy of <br />appealing to the Legislature. <br />16 <br />
