F E B 29 1994 <br />56, PA.kE?7ff <br />City Attorney Vitunac confirmed that this matter was <br />placed on the agenda for the next City Council meeting. He <br />advised that there is a memorandum attached to the 1980 <br />agreement which asks for the City Council to reaffirm its <br />understanding of that agreement. He believed it would be <br />staff's position that the 1980 agreement is different and <br />apart from the 1973 agreement, which has expired; and that <br />agreement has a force and a life of its own. He stated <br />anyone interested would be welcomed to attend the meeting <br />and ask questions at that time. <br />#2.- Round Island Park <br />Chairman Scurlock explained that the County is <br />concerned about finding a vehicle to maintain control of <br />Round Island Park to allow its development under the County <br />park's master plan, especially since it will probably be one <br />of the last areas to be developed on the beach because it is <br />considerably removed from some of the more populated areas. <br />He reported that the County has pursued an approach to <br />establishing an overall master plan in order for owners.of <br />the adjoining property to be fully aware that future use of <br />the park would probably include tennis courts, boat ramps, <br />concession stands, etc. <br />Attorney Brandenburg expressed his concern that when <br />the County park is developed in ten years, it will be <br />surrounded by property owners who will be residents of the <br />City of Vero Beach by virtue of the annexation, and could, <br />therefore, appeal to the City Council that certain uses of <br />the park are not appropriate. He recalled that he had been <br />involved in a similar case in another county where it took <br />over three years to resolve the situation, and then only <br />after the Florida Legislature had threatened to de -annex the <br />town. <br />4 <br />
