MAR 71984 <br />BOOK 56 FADE 314 <br />RESOLUTION NO. 84-18 <br />I A RESOLUTION OF THE BOARD OF COUNTY COMNBSSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR <br />CERTAIN ADDITIONAL ASPHALT PAVING IMPROVEMENTS <br />TO 11TH AVENUE BETWEEN 2ND STREET AND THE SOUTH <br />RELIEF CANAL; PROVIDING THE TOTAL ADDITIONAL <br />COST, METHOD OF PAYMENT OF ADDITIONAL ASSESS- <br />MENTS, NUMBER OF ANNUAL INSTALLMENTS, AND LEGAL <br />DESCRIPTION OF THE AREA SPECIALLY BENEFITED. <br />WHEREAS, the County Public Works Department has received a <br />public improvement petition, signed by more than 2/3 of the owners of <br />property in the area to be specially benefited, requesting paving and <br />drainage improvements to 11th Avenue , between 2nd Street and the South <br />Relief Canal; and <br />WHEREAS, the petition has been verified and meets the <br />requirements of Ordinance 81-27; and <br />WHEREAS, the total estimated cost of the proposed improve- <br />ments is $16,365.20; and <br />WHEREAS, the County constructed paving and drainage improve- <br />ments costing $10,119.07 along 11th Avenue in June, 1983, due to adverse <br />weather conditions, base preparation, and asphalt placement, additional <br />asphalt was placed in November, 1983, costing $1,985.05; and <br />WIiEREAS, prior to placeanent of the above additional asphalt <br />the County assessed the property owners $3.7686 -per front foot which was <br />substantially less than the approved, advertised, preliminary estimate of <br />$5.655 per front foot; and <br />WHEREAS, an additional special assessment is provided <br />hereunder and shall, for any given record owner of property within the area <br />specially benefited, be in an amount equal to that proportion of seventy- <br />five percent(75%) of the total additional cost of the asphalt paving which <br />the number of lineal feet of road frontage owned by the given owner bears <br />to the total number of lineal feet of road frontage within the area spe- <br />cially benefited, and shall become due and payable at the Office of the Tax <br />Collector of Indian River County ninety (90) days after the date of this <br />resolution; and <br />WHEREAS, Indian River County shall pay the remaining twenty- <br />five percent(25%) of the total additional cost of the project; and <br />WHEREAS, the rate of special assessment shall be equal to <br />$.7190 per front foot for each owner, equaling the total additional assess- <br />ments reflected in the attached assessment roll; and <br />WFMREAS, this Resolution shall serve as approval for both <br />the preliminary and final assessment rolls for this project; and <br />WHEREAS, any special assessment not paid within said ninety <br />(90) day period shall bear interest beyond the due date -at a rate of 12% <br />per annum and shall be payable in two (2) equal installments, the first to <br />be made twelve (12) months from the due date and the second to be made <br />twenty-four(24) months from the due date; and <br />36 <br />
