Administrator Wright emphasized that it would not be <br />feasible for us to serve that area one way or the other, but <br />noted that there is no obligation to make the turnover at <br />this point in time; there is a time however, when this is <br />automatically turned over if we do nothing. This was merely <br />a request by the City to get the issue out of the way so we <br />could all move ahead. <br />Commissioner Bird felt we will know even earlier than <br />May whether or not this issue will even go to a ballot, and <br />maybe we could wait to see the outcome of that. <br />Commissioner Lyons stated that he would amend his <br />Motion to say that the Chairman is authorized to send the <br />letter at an appropriate time. <br />Further discussion ensued as to the County's position <br />if this property is not annexed, and Chairman Scurlock <br />stated that they would come to us and ask for a franchise <br />for an independent system just like any other place. It <br />doesn't change the City's position or our position. <br />Attorney Brandenburg clarified that we would be turning <br />over 255 vested customers, plus all the improvements we have <br />made, but all the unserviced areas would still remain in our <br />service area. <br />Administrator Wright noted that if we had put in the <br />sub -aqueous crossing, we would have gotten everything south <br />of the City limits. <br />Commissioner Wodtke stated that his only comment was <br />based on the statement made by Attorney Brandenburg that the <br />City's position in regard to serving other areas might <br />possibly change after the annexation question is settled, <br />and he felt if we wait for the vote, maybe our agreement <br />would be different. <br />Further discussion ensued regarding this reverting <br />automatically in 1985. <br />47 <br />MAR 7 1984 <br />PooK 56 PAGE 35 <br />
