MAR 7 1984 BOOK 56 Fcf <br />d COMMISSIONER LYONS WITHDREW HIS MOTION AND COMMISSIONER <br />BIRD WITHDREW HIS SECOND. <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bird, the Board unanimously <br />tabled discussion re turnover of South Beach <br />water taps to a future meeting. <br />FILING OF COUNTER CLAIMS IN LAWSUITS VS. THE COUNTY <br />Attorney Brandenburg noted that there are two lawsuits <br />pending against the County in which he would like to be <br />authorized to file counterclaims to require the discontinu- <br />ation of grapefruit and orange processing plants. <br />Motion was made by Commissioner Wodtke, seconded by <br />Commissioner Bowman, to authorize the filing of counter- <br />claims in the lawsuits filed against the County by Davis and <br />Vero Beach Groves and by Campbell Food & Spirits and Plasse. <br />Commissioner Bird asked what these suits are based on, <br />and Attorney Brandenburg explained that they are based on a <br />misinterpretation of our Code which does not allow them to <br />continue their operation. We would claim that we have <br />interpreted our Code correctly and ask the Court to enjoin <br />these operations. <br />Assistant County Attorney Chris Paull clarified that <br />we are trying to get these issues all into one lawsuit so we <br />don't have to go back to our Code Enforcement Board. These <br />are two individual suits; they have not joined together, but <br />it is possible we might be able to consolidate the action. <br />Commissioner Lyons stated that he would like to have <br />some discussion as to whether our rule really makes sense or <br />whether we may -be prohibiting something that possibly should <br />be allowed. He noted that these people have considerable <br />investment involved in their operations, and he believed <br />that out of courtesy, we should review our ordinance; if we <br />�3 <br />
