MAR 14 194 <br />Btax 56 PA6f. 2 <br />apartment or a condominium, the internal driveway isles and <br />streets.are not usually dedicated to the public and they are <br />considered part of the gross acreage. In a subdivision, the <br />Zoning Code specifies minimum lot sizes, so the rights of <br />way would not be considered. There are several other <br />situations that are comparable to this. In essence, what we <br />are saying in this proposed amendment is really not that the <br />density would be transferred, but when it is considered, the <br />total acreage would include the right-of-way. Commissioner <br />Lyons felt this apparently is not inconsistent with what we <br />are doing now, and Chairman Scurlock believed the ordinance <br />to be helpful in building roads and should have been <br />considered long before this. <br />Commissioner Wodtke asked if this ordinance would have <br />applied to the recent right-of-way donation on the east side <br />of the Vista Properties project out on SR #60. Director <br />Keating explained that this ordinance would not have <br />affected that project because we would have asked for the <br />right-of-way dedication for the entire parcel at the time of <br />site plan approval. The big difference in extending Indian <br />River Boulevard is that we are asking for all the <br />right-of-way now, and a lot of the parcels are not ready for <br />development. <br />Commissioner Wodtke felt this ordinance would work to <br />the County's benefit and would encourage the dedication of <br />land. <br />Question was raised as to how the application of this <br />ordinance would affect commercial and industrial acreage, <br />and after some discussion it was generally agreed that staff <br />should look into this further. <br />6 <br />Attorney Brandenburg suggested the insertion of and <br />accepted by the County in the first sentence of Section 1 on <br />Page 1 of the ordinance so that the sentence would read: <br />All land area requested by the County for street or road <br />31 <br />
