A -PW 4 1994 sooK 56 PACE 544 <br />Richard Shearer, Chief, Long -Range Planning, showed <br />slides of the site and explained staff's recommendation for <br />approval of the rezoning with a provision that the applicant <br />maintains a cap of 8 units an acre for this particular site. <br />Commissioner Wodtke asked if it was legal to approve <br />the rezoning with the provision for a cap of 8 units, and <br />Attorney Brandenburg explained that the Comprehensive Land <br />Use Plan controls the cap on that density, and the County <br />cannot allow a development permit to be issued above that <br />density. <br />Mr. Shearer further explained that the Comp Land Use <br />Plan has the property designated as MD -1, Medium Density <br />Residential, with a cap of 8 units per acre, and the site <br />plan process assures that they will not exceed that cap. <br />Commissioner Wodtke asked if the 8 units per acre cap <br />should be included in the Motion to rezone and the <br />Commissioners agreed that it should not be included in the <br />Motion. <br />Chairman Scurlock opened the Public Hearing and asked <br />if anyone wished to be heard in this matter. <br />Helen Flynn, resident of Vista Del Mar, did not <br />understand why this site should be limited to 8 units per <br />acre when Vista Plantation, which is being built in that <br />same general area, is going to be allowed 16 units per acre. <br />Robert Keating, Director of Planning & Development, <br />explained that the zoning for Vista Plantation is R2 -A and <br />they are in a LD -2 land use designated area. As such, they <br />can have a maximum of 6 units per acre, but their site plan <br />has been approved for 4 units per acre. After this <br />explanation, Mrs. Flynn emphasized the need for such a <br />facility in this area and urged the Commission to approve <br />the rezoning. <br />33 <br />s � � <br />
