Boa 56 : WE 602 <br />COUNTY ATTORNEY'S OFFICE - OFFER OF SETTLEMENT ON DEMOLITION <br />LIEN AND A REQUEST FOR AUTHORITY TO FORECLOSE <br />The Board reviewed the following -memo dated 3/29/84: <br />TO: Members of the DATE: March 29, 1984 FILE: <br />Board of County Commissioners <br />SUBJECT: Offer of Settlement on <br />Demolition Lien -- <br />Request Authority to Foreclose <br />FROM: Christophe J. Paull REFERENCES: <br />Assistant`County Attorney <br />This office requests input from the Board on the following: <br />1. We have received an offer of settlement of $1,500.00 from an <br />attorney representing the Estate of Ethel Ruth Ross, the owner <br />of property against which the County has a lien dated January <br />10, 1979, in the original amount of $1,747.36, plus 6% <br />interest, currently totaling $2,369.88 (see attached lien). It <br />is necessary that the Board either accept or reject this offer, <br />and if the offer is rejected, it is requested that the Board <br />authorize this office to initiate a foreclosure claim against <br />the estate and to carry on negotiations thereafter. <br />2. Request authority to initi-ate foreclosure action to collect a <br />demolition lien dated January 10, 1979, in the original amount <br />of $834.23 plus 6% interest, currently totaling $1,130.00, said <br />action to be taken against Gwendolyn Jones, the current owner, <br />and any others who might be liable. It appears there has been <br />a conveyance of this property subsequent to the date of our <br />lien and there may be a title insurance policy which will <br />provide coverage for our claim. The title company will not <br />redress this claim, however, until some formal action is taken <br />against their insured, Gwendolyn Jones. <br />Assistant County Attorney Chris Paull advised that this <br />item is merely a request for direction from the Board. He <br />is in the process of attempting to collect on a couple of <br />old demolition liens. <br />Item #1 <br />Attorney Paull felt that rather than authorizing <br />foreclosure, there was a chance that we may receive a better <br />offer if the Board rejects this first offer. <br />
