The Commissioners felt that if the City rejects the <br />first request, a second request for a temporary transfer of <br />100,000 gallons from the 6th Avenue allocation should be <br />formally placed on the City Council agenda. <br />ON MOTION by Commissioner Lyons, <br />SECONDED by Commissioner Bird, the Board <br />by a vote of 3-1, Commissioner Wodtke dissenting <br />and Commissioner Bowman absent, authorized the <br />Chairman to pursue the second alternate if <br />the first request is refused, by formally <br />requesting the City of Vero Beach to transfer <br />100,000 gallons from the 6th Avenue allocation <br />on an interim basis. <br />DISCUSSION RE JAIL PROJECT <br />Administrator Wright reported there have been <br />negotiations with Frizzell Architects to answer some of the <br />questions raised at the last meeting. Attorney Brandenburg <br />and Attorney Marcham, representing PDR, have secured a <br />release whereby PDR will not sue the County in the matter of <br />fees. To date we have paid Frizzell $52,000 for the PDR <br />design that was subsequently rejected; this was based on <br />1000 of schematic design figured on construction costs of <br />$6.6 million for the original jail design. Mr. Bail, <br />President of Frizzell Architects, has agreed to Indian River <br />County paying full schematic design fees for the $4.8 <br />million jail designed by PDR. The County Administrator <br />explained that the architects are claiming that because we <br />reduced the scope of work from $6.6 million to $4 -million, <br />they encountered additional costs for additional services <br />outside the contract in the amount of $13,000. Mr. Bail <br />originally asked for 150 of the $4 -million jail, or $41,500, <br />plus extra services of $13,000.
