APR 111984 BOOK 56 PAGE 6.96 t <br />Chairman Scurlock believed the Commission is indicating <br />that they are willing to go with either a license type <br />operation or a franchise so long as we don't get involved in <br />the rates. <br />Attorney Brandenburg explained that the Board could set <br />up a limited franchise; we could have a very short ordinance <br />stating that no septage hauler can conduct business here <br />without first obtaining a permit from the county, and as a <br />condition to the permit, they would be required to enter <br />into a very short franchise laying out the standards <br />mentioned by the Utility Director, requiring depositing the <br />material at an approved site, etc., <br />Michael Galanis, Director of Environmental Health, felt <br />he had a bit of conflict. There still is a problem with the <br />fly-by-night operators; so, the State is proposing to <br />license them, etc., effective July 1st. If the County has a <br />license fee, and he also has a license fee, there could be a <br />problem. <br />Chairman Scurlock stressed that we do not want to get <br />into a bureaucratic situation and have a duplication of <br />fees. He felt if Environmental Health wants to handle this, <br />that would be fine. <br />Mr. Galanis pointed out his problem is that even when <br />the state authorizes the licensing procedure, his only <br />option for enforcement is Circuit Court. The approach he <br />would rather see is through a local ordinance so that <br />violations can be dealt with through the Code Enforcement <br />Board at a local level. He continued that the DER has a new <br />septic and sludge hauling rule (17-7) on which they are <br />- planning to hold a workshop here soon. His rules will be <br />based on the DER rules, but where the system breaks down is <br />enforcement, and Mr. Galanis believed a local ordinance <br />would provide the answer. <br />12 <br />
