INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, INDIAN RIVER COUNTY, hereinafter referred to - <br />as "County," and W. R. FRIZZELL ARCHITECTS, INC., hereinafter <br />referred to as "Frizzell," entered into a contract dated October <br />:3 <br />6, 1982, and <br />WHEREAS, under the terms of that agreement, Frizzell <br />agreed to perform certain architectural and planning functions for <br />the County in connection with the Indian River County Criminal <br />Justice Complex, and <br />WHEREAS, the scope of the planning study was subse- <br />quently expanded to include a court facilities study to be coordi- <br />nated with the Criminal Justice Complex Project, and <br />WHEREAS, the architect and their agents developed an <br />initial schematic design for the site which in the opinion of the <br />County Commission would result in too costly a project, and <br />WHEREAS, pursuant to the County's direction to reduce <br />the scope of the project and to provide a more cost effective <br />design, the architect produced a subsequent schematic design esti- <br />mated to have a construction cost of FOUR MILLION EIGHTY-THREE <br />THOUSAND NINE HUNDRED DOLLARS and 00/100 ($4,083,900.00). The <br />County reviewed and approved this design upon the recommendation <br />of the architect, and <br />WHEREAS, subsequent to approving the new design <br />another new design concept.was presented by Frizzell which appears <br />to be less costly in construction and more efficient in staffing, <br />hereinafter referred to as the "Pinkerton Jail," and <br />WHEREAS,Indian River County desires the architect to <br />utilize the Pinkerton Jail in Indian River County and as a result <br />of this decision the parties have reached an agreement with <br />respect to the method of calculating the appropriate fee due to <br />i <br />architect for his services under the schematic design phase pursu- <br />ant to the October 6, 1982 agreement. <br />NOW, THEREFORE, the parties agree as follows: <br />1.
