RE80LUTION NO. 84- 27 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF.INDIAN RIVER COUNTY, FLORIDA ACCEPTING DEDICATION <br />OF CERTAIN DRAINAGE EASEMENTS WITHIN SUN VILLA WEST <br />AND`GLENWOOD SUBDIVISIONS. <br />WHEREAS, on May 10, 1980, the County officially <br />approved for recordation the plat of Glenwood Subdivision; and <br />WHEREAS, on November 8, 1973, the County officially <br />approved for recordation the plat of Sun Villa West Subdivision; <br />and <br />WHEREAS, each plat established and dedicated certain <br />'9 <br />easements for the use of the property owners -within the <br />subdivision with the understanding that the easements would not be <br />dedicated to the public, nor maintained by the County, until there <br />was a formal acceptance by the County of the easements, or any <br />part thereof; and <br />WHEREAS, after examination and review by the Public <br />Works Department of certain drainage limitations of the County's <br />drainage system within this area, the County has determined that <br />the acceptance, use, improvement, and maintenance of certain of <br />theseestablished easements would enhance the ability of the <br />County to drain properties in the area and would better serve the <br />public's interest; and <br />WHEREAS, any acceptance stated below shall be <br />considered to constitute an express revocation of any waiver which <br />may expressly or impliedly have been made to date with respect to <br />the plat dedications. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The foregoing recitals are affirmed in their <br />entirety. <br />2. Indian River County hereby formally accepts itself, <br />successors or assigns for all proper purposes, including but not <br />limited to the use, improvement, and maintenance as a public storm <br />water drainage facility, the following easements: <br />a) That certain fifteen foot drainage easement lying <br />within the east fifteen feet of lots 7 through 12, and running the <br />3 <br />APR 18 1984 BOOK 56 PAGEMd <br />
