MAY 2 1984 <br />BOOK 5 PAGE 816 _ <br />Chairman Scurlock explained that when the Hospital was <br />built, they had a current height limitation, which they <br />circumvented by going before the Variance Board and <br />obtaining a variance to go to 137', which variance is still <br />in effect. <br />Commissioner Wodtke raised the question as to whether, <br />under our present laws, the Variance Board has the right to <br />give a variance for height, and Attorney Brandenburg felt <br />that was a real close issue. <br />Commissioner Wodtke expressed concern about possibly <br />opening ourselves up to problems if it was found that the <br />variance for nine floors was granted in error, and <br />Commissioner Lyons felt there are other ways than a variance <br />to go about this, i -.e., a special exception category, etc. <br />It was determined that no one further wished to be <br />heard. <br />ON MOTION by Commissioner Bird, SECONDED <br />by Commissioner Lyons, the Board unanimously <br />(4-0) closed the public hearing. <br />Commissioner Bird suggested ending Paragraph (d) on <br />Building Height Limit after the word "ordinance" and <br />striking everything else in that paragraph. Attorney <br />Brandenburg stated that would be satisfactory. <br />ON MOTION by Commissioner Bird, SECONDED <br />by Commissioner Lyons, the Board unanimously <br />(4-0) adopted Ordinance 84-24 establishing <br />a new zoning district to be known as the MED, <br />Medical District, with the amendment that <br />all the wording in Paragraph (d) Building Height <br />Limit, after the word "ordinance be stricken. <br />77 <br />
