MAY 21994 <br />BOOK 56 `PAGE 890 <br />The Chairman asked Utility Service Director Pinto to <br />make the staff presentation. <br />Director Pinto commented that the testimony that would <br />be presented today would be sworn testimony and stated that <br />what he would prefer to do is first hear the applicant and <br />his wishes, and after that staff will review their findings. <br />Attorney Steve Henderson came before the Board <br />representing Breezy Village Water & Sewer Company and Dr. <br />James Wilson, the applicant. Attorney Henderson noted that <br />what they have asked the Commission to do is go ahead and <br />hear the matter re transfer of the franchise, which is not <br />necessarily evidentiary, and to grant a continuance of the <br />rate hearing for 30 days on the grounds that although their <br />application was filed in September of 1983, they only <br />received the report of the Utility Department one week ago, <br />at which time his firm was retained and consequently they <br />have had very little opportunity to analyze the report and <br />prepare a presentation. He further informed the Board that <br />both he and the accountant find themselves pretty much in <br />agreement with the report of the staff and would like to <br />make amendments to their application and rate request to <br />conform to the recommendations of staff to the extent that <br />they are in agreement with them. <br />Attorney Henderson then referred to the Memo of <br />Assistant Utility Director Joseph Baird, dated April 29, <br />1984, giving the Rate Review Committee Report, which is as <br />follows: <br />91 <br />
