May 2, 1984 <br />ARTICLE 5. GENERAL SERVICES DURING CONSTRUCTION: <br />5a-. The Consultant hereby agrees to furnish general engineering <br />services during construction of projects for which drawings, <br />specifications and contract documents have been previously <br />prepared by.the Consultant. The services shall include advice and <br />assistance to the County in the receipt and analysis of bids and <br />the award of construction contracts, advice during construction, <br />preparation of such sketches as are needed to resolve actual field <br />conditions, the review of shop drawings and working drawings <br />submitted by the contractors, visits to the site at intervals <br />appropriate -to the various stages of construction to observe 'as an <br />experiencedand qualified design professional the progress and <br />quality of the executed work of contractors and to determine 3n <br />general if such work is proceeding in accordance with the contract <br />documents, review of cost estimates for payments to the <br />contractors during the progress of and upon completion of the <br />contracts, and to oversee the final testing and final inspection <br />of completed works. <br />5b. The Consultant shall not be required to make exhaustive or <br />continuous on-site inspections to check the quality or quantity of <br />such work. The Consultant shall not be responsible for the means, <br />methods, techniques, sequences or procedures of construction <br />selected by contractors or the safety precautions and programs <br />incident to the work of contractors. The Consultant's efforts <br />will be directed toward providing a greater degree of confidence <br />for the County that the completed work of contractors will conform <br />to the contract documents, but the Consultant shall not be <br />responsible for the failure of contractors to perform the work in <br />accordance with the contract documents. During.such visits and on <br />the basis of on-site observations, the Consultant shall keep the <br />County informed of the progress of the work, shall endeavor to <br />guard the County against defects and deficiencies iR such work and <br />-- may disapprove or reject work failing to conform to the contract <br />documents. <br />5c. If requested by the County or recommended by the Consultant and <br />agreed to in writing by the County, a Resident Project <br />Representative will be furnished and will act as directed by the <br />Consultant in order to assist the Consultant in observing <br />performance of the work of contractors. <br />(1) The duties and responsibilities and the limitations ori the <br />authority of the Resident Project- Representative and <br />assistants will be set forth in Exhibit "A" which is to be <br />identified, attached to, and made a part of this Agreement. <br />(2) Through the more extensive on-site observations of the work in <br />progress and field checks of materials and equipment by the <br />Resident Project Representative (if furnished) and assistants, <br />the Consultant shall endeavor to provide further protection <br />for the County against defects and deficiencies in the work of <br />contractors; but the furnishing of such Resident Project Re- <br />presentation will not make the Consultant responsible for <br />construction means, methods, techniques, sequences or proce- <br />- 3 - <br />64a/116P/050284 <br />Boa 57 PAGf •9� <br />
