The water distribution system in the <br />subdivision has been installed and accepted by the County's <br />Utilities Division. The drainage system is also complete. <br />Because of the extent of the work which had been done prior to <br />the expiration of preliminary plat approval, the applicants <br />have requested that the Board of County Commissioners waive the <br />time limit provision of the ordinance. <br />In addition to taking into consideration the amount of work <br />which has been done on site, staff considered what new County <br />ordinances would be applied to this- development, if a re- <br />application for preliminary plat approval became necessary. In <br />the time since this subdivision received preliminary plat <br />approval, the County has adopted new stormwater drainage, <br />subdivision, and tree protection ordinances. In addition, the <br />state has adopted -new laws concerning the use of septic tanks. <br />In reviewing the Pinecrest III Subdivision application from the <br />perspective of these ordinances, it seems that the subdi- <br />vision's design would not change substantially if a reapplica- <br />tion were necessary. The County Engineer has reviewed the <br />variance request and stated that the subdivision's on-site <br />drainage is adequate. The Utilities Division has confirmed <br />that the water system has been inspected and is complete. All <br />lots within the subdivision meet the state's h acre minimum lot <br />size requirement for the use of septic tanks, where a public <br />water, system is available. The Planning and Development <br />Division has reviewed the variance request and original subdi- <br />vision application for conformance with the County's new <br />Subdivision Ordinance 83-24. Thus, it seems that, if the Board <br />of County Commissioners denied the variance request and <br />required the applicant to resubmit a request for preliminary <br />plat approval, the County would not benefit to any large <br />degree. <br />The applicant's request for final plat approval has also been <br />reviewed by staff. As stated previously, the development's <br />on-sitevimprovements have been completed to the satisfaction of <br />the Public Works Division and Utilities Division. In addition, <br />the developer has posted a $900 seeding maintenance bond. The <br />final -plat is in conformance with the approved preliminary <br />plat. And, finally, the final plat has been approved as to <br />legal sufficiency by the County Attorney's office. Thus, all <br />County requirements for final plat approval have been met by <br />the applicant. <br />RECOMMENDATION: <br />Based upon the analysis presented herein, staff is making the <br />following recommendations. First, staff recommends that the <br />Board of County Commissioners grant a variance from the time <br />limit provision of the Subdivision Ordinance, thus extending <br />preliminary plat approval until final plat approval is granted. <br />Secondly, staff recommends that the Board of County Commission-. <br />ers grant final plat approval to Pinecrest #3 Subdivision and <br />accept the $900 bond posted by the applicant to ensure that the <br />grass seeding is maintained. <br />M <br />M <br />
