Poupard /fIf REFERENCES: Pinecrest III <br />Staff Planner J DIS:CLARE <br />It is requested that the following information be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on June 6, 1984. <br />DESCRIPTION AND CONDITIONS: <br />Pinecrest #3 Subdivision is comprised of 32 lots on a ±10 acre <br />site.. The development is located west of Old Dixie Highway and <br />north of 4th Street. The .subject property is zoned R-1 (6.2 <br />dwelling units/acre) and has a LD -2 land use designation (6 <br />dwelling units/acre). The project's proposed density is 3.2 <br />dwelling units/acre. <br />The applicant received preliminary plat approval on September <br />2, 1981. This approval would have elapsed on March 2, 1983. <br />However, the applicant received a six month extension, and <br />thus, preliminary plat approval expired on September 2, 1983. <br />Therefore, the applicant is making a two -fold request. The <br />applicant is requesting that the Board of County Commissioners <br />grant a variance from the time limit provision of the County's <br />subdivision ordinance, and that the Board of County Commission- <br />ers subsequently grant final. plat approval to Pinecrest #3 <br />Subdivision. <br />V <br />ALTERNATIVES AND ANALYSIS: <br />The first request made by the applicant is for a variance from <br />the time limit provision of the County's Subdivision Ordinance. <br />According to the provisions of Section A(3)(g) of the County's <br />Subdivision Ordinance 75-3, (the ordinance which was in effect <br />at the time that the Pinecrest III Subdivision preliminary plat <br />approval request was submitted and approved), <br />"g) The following limitations and conditions are placed on the <br />preliminary plat approvals given by the Board: <br />(1) The approval of the Board shall have full force and <br />effect for a period of 18 months from the date of <br />approval. An extension may be granted by the Board. <br />(2) If no final plat has been filed for the area covered <br />by the preliminary plat before the approval period <br />has elapsed, the approval shall be revoked. If final <br />plats are filed for only a portion of the preliminary <br />plat, the approval on the remaining portions shall be <br />revoked unless an extension of time has been granted <br />by the Board." <br />As the ordinance states, if a final plat has not been filed <br />before the preliminary plat approval expires, plat approval <br />becomes null and void.
