El <br />Director Pinto advised that three separate motions are <br />needed. Project #1 <br />MOTION WAS MADE by Commissioner Lyons, <br />SECONDED by Commissioner Wodtke, that the <br />Board award Contract #1 for Project U84-1 to <br />Caldwall Tanks, Inc. of Louisville, Kentucky, <br />for the construction of a water storage <br />tank in the amount of $747,700; and authorize <br />the Chairman's signature contingent upon prior <br />approval by Farmers Home Administration. <br />Attorney Brandenburg pointed out that while $1 -million <br />will be obtained from Farmers Home, the remaining amount <br />will be obtained through the assessment, and the assessment <br />is not in place as yet and won't be for at least a couple of <br />months. He recommended that these contracts be written with <br />contingencies in place in the event that something happens <br />with the assessment. In order words, if the assessment blew <br />up and someone filed a law suit contesting it, or if the <br />court did not validate it, the County would not have the <br />$2 -million from the assessment to pay for part of the cost. <br />If there aren't any other funds available, there has to be <br />some language included to allow the County to get out of the <br />contract if something happens to the extent that the County <br />does not have the money to pay for the project. <br />Director Pinto stated that if they are not going to pay <br />for it, it is not going to get done. <br />Administrator Wright thought that possibility was very <br />remote, but agreed it does exist and some language should be <br />included in the contract.
