He further noted that Oslo Road is designated as an arterial <br />road in the County Thoroughfare Plan and stated that he, <br />personally, would not like to rear his family in this area, <br />which is next to a highway that is traveled by 6,000 <br />vehicles a day. <br />Ronald McDougald, who w4s born and raised on the <br />subject property, confirmed that Oslo Road was a very busy <br />highway. He noted that his family has had a commercial <br />operation in this area since 1946, and he could not <br />understand why this property did not get "grandfathered" in <br />like the place across the street, Timber Ridge Tennis Ranch. <br />Mr. McDougald also pointed out that the Planning and Zoning <br />Commission had voted 3-1 to recommend approval of the <br />redesignation because of special conditions that warranted <br />the change. <br />Bill Stegkemper, experienced realtor and property <br />appraiser in Indian River County, spoke as an expert witness <br />on behalf of the property owners, citing the case of the <br />Marcella Villa tract on 20th Street in Vero Beach across <br />from St. Helen's Catholic Church, wherein the City denied <br />the owner's request for rezoning from R-1 Residential to R-2 <br />so that it could be used for offices, but after a long court <br />procedure, the Fourth Circuit Court of Appeals ruled that <br />the City had to rezone the property to R-2. Mr. Stegkemper <br />also referred to the recent decision by this Commission to <br />include the Fleischmann property in the U.S. #1 and Oslo <br />Road commercial node, and emphasized that the Comprehensive <br />Land Use Plan states that "certain parcels of land which do <br />not conform to the policies for nodal development, but which <br />can be demonstrated to be suitable for commercial or <br />industrial development and otherwise meet standards <br />described in this element, may receive consideration by the <br />Board of County Commissioners for commercial or industrial <br />zoning classification."
