Fr- <br />JUL 111984 57 <br />RECOMMENDATION <br />Based on the above analysis, including the facts that the <br />subject property is not within the proposed flexible boundary <br />of the node, that:the subject property does not have access to <br />a public road and the Planning and Zoning Commission's <br />recommendation, staff recommends that this request to include <br />the subject property in the U.S.#1 and Wabasso Road <br />commercial/industrial node be denied. <br />Planner Richard Shearer presented staff's recommenda- <br />tion for denial of this request and showed the subject <br />property on the land use map. He noted that the Planning & <br />Zoning Commission also recommended denial of the request. <br />Chairman Scurlock opened the Public Hearing and asked <br />if anyone wished to be heard in this matter. <br />Steve Henderson, Attorney, representing the applicant, <br />pointed out that for the most part this property has been <br />zoned M-1 and Agricultural for many years, and the applicant <br />purchased this property in light of the present zoning. He <br />noted that while it is true that the property is one half <br />mile north of the intersection of Wabasso Road, it is <br />adjacent to the FEC railroad, and within a fairly short <br />distance of the city limits of Sebastian. <br />Attorney Henderson then discussed the boundaries of <br />nodes and stated that he could easily understand why staff <br />would find it convenient to draw in some form of flexible <br />boundaries; he felt, however, that the boundaries could be <br />regarded as somewhat inconsistent with the master Land Use <br />Plan which states in several places that the uses within a <br />node will be determined by zoning and not by drawing limits <br />around the node. He understood that the Planning & Zoning <br />Commission has not adopted any form of flexible outer <br />boundaries, which defines the limits of uses within nodes. <br />Mr. Shearer advised that this issue has been discussed <br />during several workshops, but no formal action has been <br />taken. <br />Attorney Henderson noted that the Planning & Zoning <br />Commission turned down the request specifically because it <br />30 <br />
