was outside the outer limits of the node. <br />In effect, they <br />acted upon this request in light of proposed regulations <br />which have not been adopted yet. <br />Attorney Brandenburg explained that the Comprehensive <br />Land Use Plan defines nodes as having a certain flexibility <br />to which they can expand, and he felt that the Planning & <br />Zoning Commission considered this property to be outside of <br />even the most outer limits which could be conceived. <br />Attorney Henderson submitted that the criteria that <br />should be applied to commercial activities, i.e., concentra- <br />tion around intersections, may not necessarily be appro- <br />priate with respect to industrial areas. There are some <br />strictly industrial nodes further south which are not <br />concentrated around nodes. Attorney Henderson believed that <br />the Commission will run into some problems if it is going to <br />apply the concept of noding around intersections for both <br />commercial and industrial, and he felt this request is one <br />of those problems. <br />Planning Director Robert Keating explained that the MXD <br />reaches to 300 feet of either the railroad or Old Dixie, <br />whichever is further, and pointed out that a 9 -acre portion <br />of the subject property is included in the MXD. <br />Mr. Shearer noted that at present there is no access to <br />the subject property except for the FEC railroad. <br />Attorney Henderson thought that his client might be <br />willing to build the extension of Kings Highway in order to <br />gain an access. He did not think that access means that the <br />road has to be in place at the time, and believed that site <br />plan would never be approved without it and the node <br />inclusion. <br />Attorney Henderson reminded the Commission that they <br />had determined two years ago that the shape of a node may <br />deviate in any direction around on intersection.
