DESCRIPTION AND CONDITIONS <br />Mr. Louis Biamon, resident of 19th Avenue S.W. has submitted <br />a petition for the paving of 19th Avenue S.W. from 13th Street <br />S.W. to 14th Street S.W. The petition contains signatures of <br />6 of 12 property owners along the 700 L.F. road. Mr. Biamon <br />has obtained the consent of 1 other property owner, thus obtaining <br />consent from 58.3% of the owners. The applicable front footage <br />along the road is 52.8%. <br />All property owners who have not signed the petition are from <br />out of town, 3 are from out of state, 1 is from Miami, and 1 <br />from Sebring, Florida. <br />The location of this portion of 18th Avenue S.W. is such that <br />it is between two paved roads. The only culvert located along <br />13th Street S.W. canal is at 19th Street S.W. such that much <br />traffic from the Oslo Park Subdivision that travels to the new <br />Thompson Elementary School and Oslo Road use this road. The <br />Traffic count on the road is between 300 and 400 vehicles per <br />day. There are 6 residences on the road. This road serves as <br />a subdivision feeder road. <br />ALTERNATIVES AND ANALYSIS <br />Due to the location, use and function of the road, paving <br />by the petition paving program is reconnhended, however, the <br />residents are one signature shy of obtaining a valid petition <br />since 5 property owners are not residents of the County. The <br />following alternatives are presented. <br />Alternative No. 1 <br />Section 11-25 (page 575) of Article 3, Chapter 11, Indian <br />River County Code of Laws and Ordinances, states that the Ba,ard <br />of County Commissioners "may initiate services and/or make <br />improvements in its discretion and without petition". This <br />provision can be applied, and staff authorized to proceed with <br />design, schedule public hearing, and prepare a preliminary <br />assessment roll and resolution. for approval. <br />Alternative No. 2 <br />Amend Section 11-22 and Section 11-23, Article 3, Chapter 11, <br />of the County's Code to revise the 66.7% consent to 51% consent <br />to achieve a valid petition. This would result in more valid <br />petitions being submitted. The City of Vero Beach only required <br />51% of the benefitted owners consenting. <br />Alternative No. 3 <br />Deny the Petition as not meeting the 66,7% signature -threshold <br />and require the residents to obtain another signature. <br />44 <br />fiU L 11 �9�4 �oo� 57 PnE 652 <br />
