He noted that there currently is a non -conforming house in <br />the proposed Conline subdivision which is used as multi- <br />family and does not fit in with the character of the other <br />houses on 33rd Avenue. <br />Lengthy discussion ensued wherein Commission members <br />indicated they did not want to get into the question of <br />whether the street should be cut through as this is <br />something the residents should decide with the City. <br />Attorney Vitunac stressed that all the City is asking <br />is that the Board accept the plat as publicly dedicated. He <br />felt the issue is who will have charge of the roads in the <br />City; it is strictly a City matter; and he felt the County <br />should not get involved. <br />Commissioner Wodtke felt Attorney Vitunac must remember <br />that actually City residents are the County Commission's <br />constituents as well, and Commissioner Lyons noted that he <br />did not want to do anything that would in any way jeopardize <br />the people's position. He believed that the County was <br />involved, whether rightly or not, since whatever the <br />Commission decides today unquestionably will determine <br />whether that street goes through or not. If the City is <br />concerned about having private streets, he noted that the <br />Commission can accept the part that is already constructed. <br />Attorney Vocelle was not sure the County has the option <br />of accepting the road without accepting the entire plat.. He <br />pointed out that the residents have been afforded the <br />opportunity for a hearing, and felt if the County denies <br />this, they basically are usurping the City Council's <br />function. <br />Attorney Lyqns noted that the language on the plat <br />states "any part thereof" which he would interpret as <br />allowing the,County to accept any part, and Attorney <br />Brandenburg agreed with that interpretation. <br />47 <br />AUG 2 2 19SAI <br />BOOK. �� F'AGE S� <br />
