If they can keep the 28' <br />buffer strip referred to by Mr. Edwards to protect their <br />children, and if 18th Street could be cut in for access to <br />the subject property, he felt they all would be happy. <br />Administrator Wright reported that the Right -of -Way <br />Department informs him that there is no platted right-of-way <br />that would be where 18th Street would come out. There is a <br />30' drainage easement, which is -a Drainage District right- <br />of-way. The person who sold the property to M.A.Ford did <br />retain 60' which he intended for a road; however, this is <br />not platted; it is privately owned 100th Avenue is a <br />platted public right-of-way. <br />It was determined that no one else wished to be heard. <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bowman, the Board unanimously <br />(4-0) closed the public hearing. <br />Motion was made by Commissioner Lyons to extend the <br />node to include the O'Haire property, but Attorney Paull <br />pointed out that extending the node would actually entail <br />reallocating the acreage in the node and would require <br />special conditions. The same result could be achieved by <br />applying the policy in the Land Use Plan for certain parcels <br />which do not conform to the policy for nodal inclusion but <br />can be demonstrated to be suitable for commercial or indus- <br />trial development. He stated that the Board then would have <br />to agree there is no acreage available and identify what is <br />peculiar to this property that would allow it to be <br />identified for commercial zoning. <br />Commissioner Lyons withdrew his Motion. <br />45 <br />BOOK 151 <br />
