r <br />SEP 1.9 1984 <br />BOOK 58 F'',GF, <br />John Lyon, the applicant and developer of the proposed <br />site plan and who also owns a unit in Vista Royale, <br />proceeded to address the concerns mentioned today. <br />1) As far as non -conformity is concerned, it has always <br />been in conformance with the Comp Plan. The radio station <br />has been there since 1954 and an insurance office was also <br />located on the property. The radio station's transmitter <br />was in the building and there was an engineer on the <br />premises until the radio tower ceased operation on August <br />15, 1984. <br />2) It is his belief that property values will increase, not <br />decrease. <br />3) As to traffic safety, he reported that when Vista Royale <br />Association tried to get DOT to put a traffic light at the <br />north entrance because of the high use and the high accident <br />rate, DOT found that it was was not a high use section and <br />that it did not have a high accident ratio. DOT has <br />determined that there will not be a light installed there <br />until the traffic count increases. In addition, Mr. Lyon <br />advised that the acceleration lane could be the deceleration <br />lane. <br />Attorney Brandenburg addressed Mr. Putnam's concerns <br />over the County running into legal problems if the Board <br />approves this site plan. He believed Director Keating's <br />viewpoints on the way he has interpreted the legal aspects <br />of the Comprehensive Land Use Plan are correct. When the <br />plan was being adopted, one of the largest issues <br />confronting the Commission was what to do with the existing <br />uses, and as a result, language was written into the plan <br />specifying that a commercial use that was present and legal <br />on the property at the time of adoption of the plan could <br />remain and would be considered consistent with the plan.
