r <br />SEP 19 1994 Boos <br />Administrator Wright noted that with the planned <br />extension of Indian River Boulevard, a light will be <br />installed at 4th Street and U.S. #1. <br />Mr. Luckett just wanted to correct the impression that <br />Vista Royale is an ogre for not allowing access from their <br />north entrance. Florida Statute, Chapter 17., more commonly <br />known as the Condominium Code, states that allowing public <br />access to a privately owned street requires the consent of <br />at least 75% of all the property owners in the development. <br />He reported that Mr. Lyon's request for access was heard at <br />their meeting and was turned down in a resolution. There <br />was nothing else the directors -could do by Florida law. <br />Mr. Putnam asked those in attendance who support the <br />Association's position to stand and approximately 50 people <br />stood up. <br />Louise Donovan, resident of Vista Royale, explained <br />that she is just renting in Vista Royale at present and is <br />thinking of buying in the area, but advised that she <br />definitely would not purchase a unit in the area adjacent to <br />the proposed commercial area. <br />Ruth Meade, resident of Vista Royale, thought it was <br />outrageous that the retail center will have 19 store bays <br />and one restaurant on such a small site. <br />Mr. Lyon explained explained that although there were <br />19 bays, a grocery store may take as many as 6-7 and he <br />anticipated that 8 or 10 stores would occupy the 19 bays, <br />which have a total of 16,850 sq. ft. The restaurant area is <br />5495 sq. ft. <br />Frank Zord again stressed that the Board's intention in <br />implementing the Comp Plan was to stop strip zoning along <br />U.S. #1 and go to the node concept. He pointed out that <br />there is residential on three sides of the proposed site and <br />a canal on the other side;. As commercial, therefore, it <br />could be considered as spot zoning.
