OCT 101994 <br />BOOK PAGE 6,07 <br />RESOLUTION NO. 84- 94 <br />9/25/84 (27) C.A. <br />A RESOLUTION OF THE BOARD OF COU14TY <br />COMMISSIONERS OF INDIAN RIVER COUNTY <br />FLORIDA ACCEPTING AS PUBLIC CERTAIN <br />UTILITY EASEMENTS ON 33RD AVENUE AND <br />15th Street LOCATED IN TERILIL TERRACE <br />SUBDIVISION IN THE CITY OF VERO BEACH. <br />WHEREAS, by plat filed for record on June 26, 1978, and recorded on page 94 <br />of Plat Book 9, in the office of the Clerk of the Circuit Court of Indian River <br />County, the subdivider platted certain streets and easements in a subdivision <br />within the city limits of the City of Vero Beach with "full knowledge that the same <br />are not dedicated to the public until there is a formal acceptance of these streets <br />and/or easements, or any part thereof, by the county (e.s.).", and <br />WHEREAS, the City of Vero Beach desires that the utility easements on 33rd <br />Avenue and 15th Street in the subdivision be, public under the control of the <br />municipality, <br />NOW THEREFORE, be it resolved by the Board of County Commissioners of <br />Indian River County, that: <br />1) The utility easements shown on the plat of Terilil Terrace Subdivision, <br />including a utility easement over the northerly 60 -foot right-of-way dedicated for <br />future road purposes, are accepted by the county as public easements. This <br />resolution does not accept the streets shown on the plat as public. <br />2) By this acceptance it is the intention of the Board of County Commissioners <br />that the utility easements as shown on the plat will be considered municipal <br />easements, and that the county shall have no obligation for maintenance and no <br />other liability whatsoever concerning these utility easements. <br />THIS RESOLUTION was moved for adoption by Commissioner R; ,-,I , <br />seconded by Commissioner Lyons , and adopted on thelOthday of0ctober, <br />1984, by the following vote: <br />Chairman Don C.
