do under this ordinance, and that is catch the people who are <br />illegally subdividing and requiring them to comply with our law. <br />The Chairman noted that it seems as if the whole thing has <br />been a Berry wandered situation, and Commissioner WQdtke <br />concurred that it has been aimed at getting us into a situation <br />where we can't say no. <br />Mr. Galanis agreed that there definitely has been a very <br />smart attempt to circumvent the intent of the law. <br />Chairman Scurlock asked if we have notified Mr. Zorc as he <br />felt before the Board reaches any decision, those who will be <br />directly affected should be present to discuss this eye to eye. <br />It was noted that Mr. Zorc is not the representative, Visa <br />Building Corporation is, and Planning Director Keating reported <br />that their attorney, Mr. Bogosian, was supposed to be here today. <br />Mr. Galanis felt if the Board is going to suggest that these <br />people cannot have septic tanks, they need to understand that his <br />legal representation in Tallahassee has informed him that this is <br />a fairly common maneuver used in Florida to circumvent the <br />existing regulations, which require that any one project under <br />single ownership exceeding 5,000 gpd. shall go on a sewage <br />treatment plant. This has been presented as multiple owners. <br />Chairman Scurlock inquired about the nearest sewer <br />availability, and the Administrator stated that it is not even <br />close; it would be the Mall. <br />Attorney Brandenburg noted that as a practical matter, <br />whether these are rental units or whether someone owns the unit <br />and lives in it, you will have the same amount of sewage going <br />into the same septic tanks. What we are faced with is that the <br />state law happens to provide them with a loophole, and the <br />attempt here is to make them comply with the county ordinance. <br />The Planning Department is trying to get the message out to <br />everyone that if they are going to develop land, they have to <br />comply with the Planning requirements, and if we catch them <br />afterwards, they are going to have to go through the trouble and <br />27 <br />NOV 14 1984 Bou 864 <br />
