Attorney Brandenburg asked if we are going to take Building <br />Code enforcement action, and Mr. Keating noted that would take <br />months, and final plat approval is scheduled in a few weeks if <br />this plat vacation goes through. <br />In further discussion, Attorney Brandenburg suggested that <br />the Health Department in this type of situation in the future, <br />since they are basing the septic tank permit on there being one <br />ownership on one large lot, possibly should require an affidavit <br />and agreement by the person applying for the septic tank that <br />that lot will not be split in the future. <br />Mr. Galanis felt that might be a good idea and asked if the <br />Attorney would help him work out something like that. <br />Commissioner Wodtke stated that what really irritates him is <br />that they deliberately made individual applications for each <br />building under a different name because they never would have <br />gotten the septic tank permits otherwise, and here we are after <br />the fact when six units are built and others are under <br />construction, and it appears the only way to rectify this is to <br />make it legal. He wondered if by taking this action we are <br />saying anybody who comes into the rest of this subdivision, on <br />Lot 6, for instance, can build right up to the line, and then lot <br />7 can come in and get a permit and attach right up to the lot <br />line and so on down the line. <br />Attorney Brandenburg agreed that it is a disaster the way <br />this has been set up. He noted that Mr. Mitchell who is <br />developing this project is now present. <br />Mr. Mitchell commented that he had expected his attorney, <br />Richard Bogosian to be present, but he apparently is not. He <br />stated that it was never contemplated at any time that this was <br />built for rental and it has been a practice to sell these units <br />right from the start. <br />Commissioner Wodtke asked Mr. Mitchell how he will sell the <br />unit that goes right across the lot line, and Mr. Mitchell stated <br />that an association was set up by Attorney Bogosian to do so. <br />29 <br />N 0 V 14 1984 BOOK o u ��� <br />
