NOV 211984 <br />BOOK <br />a,F <br />City <br />Manager Little commented that it has taken ten <br />years <br />to <br />get this matter to this point largely because of the City <br />Council's reservations. At this point the City Council finally <br />has reluctantly agreed they are the logical entity to serve this <br />area and that they will accept the responsibility to serve all of <br />South Beach to the County line. There isn't anything in it for <br />the City except headaches, and they want no strings attached; <br />they are asking for an agreement not a Resolution; and they are <br />binding themselves to provide service. <br />Chairman Scurlock asked if Mr. Little would be willing to <br />include language that would indicate they are going to service <br />the island to the South County line on a non-discriminatory <br />basis. He emphasized that the County has no intent to encourage <br />additional private franchises; the concern merely is that these <br />individuals be served in a reasonable and cost effective way. <br />Mr. Little noted that the way the proposed Resolution is <br />written would give the County the right to issue utility <br />franchises to private companies desiring to serve in South Beach <br />where the City water service "is not available at the time of <br />application,..." but there is always the possibility the City <br />could be ready to serve in a few weeks' time. He stressed that <br />the City wants the agreement to satisfy everyone; that is why it <br />was stated that it is the city's duty and why they have tried to <br />put it in a contractually enforceable agreement. <br />Commissioner Bird stated that he did not see anything in the <br />agreement before us today that completely closes the door on <br />issuing franchises, but Attorney Brandenburg believed we would <br />have to add some language with a more specific definition of <br />"availability" or "financial feasibility." <br />City Manager Little suggested adding language as follows: <br />"provided that if the City ever is unable or unwilling to service <br />any portion of the South Beach area, the County reserves the <br />right to franchise others to provide that service." He believed <br />this actually is redundant, but felt it could be included. <br />6 <br />
