Attorney Brandenburg read the Motion made by Mr. Gunter: "That <br />the Governor and Cabinet sitting as the Administration Commission <br />acknowledge the Resolution adopted by Indian River County and the <br />voluntary compliance and cooperation of local government in <br />implementing the applicable portions of the Plan. Further, the <br />Governor and Cabinet concur that no development restrictions <br />beyond those currently existing on the approved local <br />Comprehensive Plans are imposed by virtue of the voluntary <br />compliance by Indian River County with the Hutchinson Island <br />Resource Planning Management Plan." The Attorney believed that <br />what is going to happen when that is brought up to the DCA is <br />that they will say that they agree there would not have been any <br />more development restrictions if you had complied with the Plan, <br />but you haven't, and the thing you have not done was the reduc- <br />tion of densities required until the transportation study had <br />been completed, which was a specific part of the original plan. <br />Chairman Scurlock felt we could talk about this all day, and <br />it isn't going to accomplish anything. He agreed with Attorney <br />Brandenburg that we probably should go ahead and seek an audience <br />with the Governor and try to exert some pressure, but felt it <br />will be very difficult to accomplish. <br />Land owner Pat Corrigan noted that he was at the meeting and <br />heard the Resolution being discussed. He did not feel under the <br />agreement the Governor and Cabinet made that day, that we could <br />be accused of non-compliance, and he did feel the Committee <br />ignored the Resolution. <br />Attorney Brandenburg agreed, but felt we need to get an <br />assurance from the Governor and Cabinet that we can rely on what <br />they said. <br />Discussion continued regarding having to comply, and the <br />Chairman felt we have to comply, but noted that it will be very <br />difficult to come up with something that will be fair to <br />everybody; so, we do need to call a halt until we can figure out <br />a formula. <br />63 <br />N 0 V 211984 BOOK 58 FnE <br />
