r�0V 21 1 <br />984 <br />BOOK <br />Attorney Brandenburg believed the transportation study will <br />show there is more capacity, but between now and the time that <br />occurs, all the developments that are approved will be eating <br />into the capacity, and even under that study, if there isn't <br />capacity left, they will suggest it go down to one unit per acre. <br />Commissioner Bowman asked why the Attorney felt the <br />transportation study will show added capacity, and Attorney <br />Brandenburg stated because it will analyze the assumptions made <br />by the Committee more carefully and find a more applicable <br />generation rate for our county based on actual counts to be made <br />during our peak season in February when people will be inter- <br />viewed as to their destinations. <br />Property owner, Nancy McLarty, brought up the question of ad <br />valorem taxes and felt perhaps consideration should be given to a <br />tax credit. If the density goes down to one unit per acre, Miss <br />McLarty could not believe that anyone would not expect their land <br />assessment to be lowered. She noted this would result in <br />lowering the County's tax base. <br />Chairman Scurlock felt that is true and further noted that <br />it will also limit things such as the North County Water Company <br />if there is not enough customer base. <br />Miss McLarty commented that it appears it will require at <br />least 45 days or more to enact a moratorium, and she wished to <br />know if that means anyone who can submit a site plan in that time <br />period would then be ahead of rest. <br />Chairman Scurlock felt that is exactly what you would see. <br />Miss McLarty asked if there is any other way whereby the <br />county could say the state was imposing unfair restrictions and <br />taxing restrictions. <br />Attorney Brandenburg noted that we have adopted a Resolution <br />exactly to that effect, but the difficulty is that the Statute <br />gives the Administration very broad powers in this regard. In <br />fact, these powers are so broad no one has bothered to attack <br />them. He felt this is borne out by the fact that some very <br />64 <br />� � r <br />
