M <br />Mrs. Offutt felt that eventually this will be decided on a <br />judicial level and asked if we can't take a really aggressive <br />point of view and challenge this Order. <br />Mr. Bailey suggested, because of the apparent concern about <br />people rushing in to get vested, that the Commission put in a <br />very temporary moratorium on any new plans from this point until <br />whatever time it takes to get an assurance from the Governor and <br />Cabinet that what they said is still valid. <br />Attorney Brandenburg.felt the Commission could take the <br />position with respect to all pending applications, and any others <br />they did receive at this point, that there is such a lack of <br />information regarding the transportation element that they could <br />not hold any hearings or consider any more development until <br />those assurances have been granted. He felt that would be a <br />legal position the County could take, and one which would be very <br />difficult for any land owners to challenge. <br />Mr. Weed asked about proceeding with review of applications <br />that are in, with respect to everything except the traffic <br />element. <br />Attorney Brandenburg stated that if he were working with the <br />DCA and trying to get this County designated, he would argue that <br />the county is continuing to approve applications that can be <br />developed above densities that can be handled, and they, <br />therefore, are not abiding by the plan. <br />Discussion continued at length re the dangers involved in <br />continuing to review applications and possibly being considered <br />in violation; re the fact that the municipalities are just about <br />platted out; re the traffic figures and how they were generated, <br />etc. <br />Commissioner Wodtke asked if the 19,000 trips allotted to <br />the Wabasso Bridge includes tourists, and Mr. Keating stated that <br />2,000 were estimated from the mainland to island and the rest <br />were generated from dwelling units on the island. <br />71 <br />Be% 947 <br />I <br />
