Keating AICP <br />Planning & Development <br />Director <br />THROUGH: Mary Jane V. <br />Goetzfried <br />Chief, Current Development Section <br />FROM: <br />Stan Boling ' <br />REFERENCES: <br />Colonial Hts . <br />Staff Planner <br />DIS:STAN <br />It is requested that the following information be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on November 28, 1984. <br />DESCRIPTION AND CONDITIONS: <br />VISA BUILDERS CORPORATION, et. al, are requesting that the <br />Board of County Commissioners vacate a portion of the plat of <br />Colonial Heights Subdivision. The portion of the plat for <br />which the request has been made consists of Lots 1, 2, 3, and a <br />portion of Lot 4 of Colonial Heights Subdivision. This item <br />was originally considered at the Board of County Commissioners <br />regular meeting on November 14, 1984, and continued to the <br />November 28, 1984 meeting., This is the same information <br />submitted for the November 14, 1984 meeting. <br />ALTERNATIVES AND ANALYSIS: <br />According to Chapter 177.101 of the Florida Statutes, the Board <br />of County Commissioners must ascertain three facts before it <br />approves a plat vacation request. These facts are: <br />1) that the applicant holds fee simple title to the land <br />for which the request is being made, <br />2) that the vacation, if approved by the Board of County <br />Commissioners, will not affect the ownership or right <br />of convenient access of residents within the subdivi- <br />sion <br />3) that all back taxes on the subject property have been <br />paid. <br />The applicants have submitted deeds to the Planning Department <br />showing that they hold fee simple title to the land in ques- <br />tion. No lots within the subdivision will have their means of <br />access affected by a partial plat vacation. Also, documenta- <br />tion has been submitted by the Indian River County Tax Collec- <br />tor's office certifying that all taxes on the property have <br />been paid. <br />Thus, all state requirements concerning plat vacation have been <br />met. <br />39 <br />NOV 28 1984 BOOK - U9 FnE 39 <br />
