RECOMMENDATION: <br />BOOK 5 9 FD GF 40 <br />Staff recommends that the Board of County Commissioners adopt a <br />resolution vacating that portion of the plat of Colonial <br />Heights Subdivision described as Lots 1, 2, 3, and a portion of <br />Lot 4. <br />Attorney Brandenburg explained that this matter was <br />considered at the last meeting and was postponed to give the <br />applicant a chance to come before the Board and answer some of <br />the Board's questions. He advised that .the Legal Department and <br />the Planning Department had both recommended in favor of the <br />replat at the last meeting and that recommendation still stands. <br />Stan Boling, Planner, confirmed that staff is still recommending <br />a plat vacation at this time in order for the applicant to <br />conform to the subdivision ordinance and proceed to obtain final <br />plat approval. <br />Richard Bogosian, attorney representing Visa Builders <br />Corporation, et al, explained that his client purchased numerous <br />lots in this particular subdivision from Frank Zorc, who apparently <br />had previously obtained a multiple -type rezoning from the Board <br />on the property in addition to some type of agreements from the <br />Health Dept. regarding the installation of septic tanks. <br />He was not aware of the particulars in those agreements, but <br />pointed out that his client had purchased the property with the <br />understanding that it could be developed in line with what Mr. <br />Zorc had obtained in the way of approvals. His client, therefore, <br />commenced to develop the property. <br />Attorney Bogosian felt the Board was mainly concerned with <br />one building, which is a 12 -unit townhouse. He believed the <br />first 6 units have been completed and the last 6 are in the <br />stages of construction. He emphasized that it is one building <br />and the 12 units are all sort of townhouse type apartments. <br />After 6 of the units were completed, his client came to him and <br />indicated he wanted to sell them as individual units.
