Jeannette Lier, representing the Town of Orchid, felt that <br />the Town of Orchid should do the same thing as the County and <br />suggested that the attorneys get together on this allocation. <br />Nancy Offutt questioned the "whereas" clauses in the proposed <br />ordinance and asked if they could be tempered just a bit to avoid <br />sounding like a guilty plea, but Attorney Brandenburg recommended <br />that they remain as presented. <br />Les Brockman of Longwood, Florida, asked for the sequence of <br />events leading up to the Hutchinson Island Resources Management <br />Plan, and Chairman Scurlock gave a brief review of the plan's <br />history. <br />Attorney Brandenburg explained to a gentleman in the audience - <br />that the HIMRP Committee was appointed by the Governor and has <br />been meeting for over one and a half years, and their report to <br />the Governor includes the recommendation that Indian River County <br />be included in the area of critical concern. That recommendation <br />will be submitted to the Governor and Cabinet on December 18th <br />and, in all likelihood, the Governor and Cabinet will at that <br />point authorize the DCA to commence the rule making process to <br />establish the barrier island as an area of critical concern. <br />Commissioner Bird asked if Attorney Brandenburg talked to <br />Bob Nabors, our legal contact in Tallahassee, to determine <br />whether December 18th would be the proper time for the County to <br />make our impassioned plea once again to the Governor and Cabinet <br />to exclude us from the designation. <br />Attorney Brandenburg reported that Mr. Nabors feels very <br />strongly that the State in pursuing their prosecution of this <br />point is really breaking all of our understandings of the agreement <br />we had with them; however, he recognizes that we ought to move <br />ahead with our interim measures as a safeguard.
